Global Sensor Systems, Inc. 1-Year Limited Manufacturer's Warranty

Global Sensor Systems, Inc. warrants to the owner of the enclosed product that the product will be free from defects in materials and workmanship for a period of one (1) year from the Commencement Date of use when installed by an authorized service representative (the “(1) Year Limited Warranty”). If the product fails to conform to this One (1) Year Limited Warranty during the warranty period, Global Sensor Systems, Inc. will, at its sole and exclusive discretion, either (a) repair or replace any defective product or component; or (b) accept the return of the product and refund the money actually paid by the original purchaser for the product. Repair or replacement may be made with a new or refurbished product or components, at Global Sensor Systems, Inc.’s sole and exclusive discretion. If the product or a component incorporated within it is no longer available, Global Sensor Systems, Inc. may, at Global Sensor Systems, Inc.’s sole and exclusive discretion, replace the product with a similar product of similar function. This is your sole and exclusive remedy for breach of this One (1) Year Limited Warranty. Any product that has either been repaired or replaced under this One (1) Year Limited Warranty will be covered by the terms of this One (1) Year Limited Warranty for the longer of (a) ninety (90) days from the date of delivery of the repaired product or replacement product, or (b) the remaining warranty period. This One (1) Year Limited Warranty is transferable from the original purchaser to subsequent owners, but the warranty period will not be extended in duration or expanded in coverage for any such transfer.

WARRANTY CONDITIONS; HOW TO GET SERVICE IF YOU WANT TO CLAIM UNDER THIS ONE (1) YEAR LIMITED WARRANTY

A proof of installation date by installer authorized by Global Sensor Systems Inc., in addition to a purchaser’s receipt or other proof of date of original purchase acceptable to Global Sensor Systems, Inc. is required before warranty performance shall be rendered.  Global Sensor Systems, Inc. will have no warranty obligations with respect to a returned product if it determines, in its reasonable discretion after examination of the returned product, that the product is an excluded product (defined below). Global Sensor Systems, Inc. will bear all costs of return shipping to owner and will reimburse any shipping costs incurred by the Owner, except with respect to any excluded product, for which owner will bear all shipping costs.

If the product is within the ninety (90) day or other return period of an official Global Partners Distributor or other seller, such return will be the sole and exclusive remedy under this One (1) Year Limited Warranty.

For products that are beyond this return period but within the one (1) year warranty period, the Owner must ship to Global Sensor Systems, Inc. the product as provided for in this section, paying shipping and handling.  Global Sensor Systems, Inc. will pay the return shipping for any product for which repairs or returns are covered. If the product is not in need of repairs or return, the Owner must pay shipping and handling before Global Sensor Systems, Inc. will return the product. Labor on parts is to not exceed 1 hour per part. Labor cost TBD.

SHIPMENT INSTRUCTIONS

1. Contact a Global Sensor Systems customer service representative before sending any item in for warranty repair or replacement.  Global Sensor Systems Customer Service can be contacted at salesglobal@globalsensorsystems.com, or 1-905-507-0007.
2. If your product is approved for return, place the product, along with any accessories and original packaging (if available), in a proper shipping package.  Include any documentation necessary to facilitate the warranty, including the original purchase invoice.
3. You will be given a Return Authorization Number (RMA#).  Include this number in the package documenation, or write on the outside face of the package (as “RMA# _____________”)
4. The customer is responsible for arranging shipping of the product to Global Sensor Systems offices or a Global Sensor Systems agent.  Global Sensor Systems recommends using Purolator or UPS but can accommodate a customers preferred carrier.

Global Sensor Systems will contact you by phone or email when the package has arrived, and the contents/product has been inspected. 

LIABILITY EXCLUDED PRODUCTS 

This One (1) Year Limited Warranty does not cover 1) products marked as “sample” or “Not for Sale”, or sold “AS IS,” (2) products that have been modified, altered, tampered with, neglected, abused, misused, improperly maintained or repaired, or damaged (including but not limited to shipping damage), (3) products that have been handled, stored, installed, tested, or used not in accordance with the instructions and guides provided by Global Sensor Systems, Inc., (3) products not manufactured by Global Sensor Systems, Inc. which have been supplied, installed, and/or used in conjunction with Global Sensor Systems, Inc. products, even if packaged or sold with Global Sensor Systems, Inc. products, (4) damage to the product caused by replacement parts not from Global Sensor Systems, Inc. are not covered by this warranty, or (5) acts of God, including but not limited to lightning, flood, tornado, earthquake, or hurricane. Additionally, this One (1) Year Limited Warranty does not cover consumable parts, including batteries, unless damage is due to defects in materials or workmanship of the product, or software (even if packaged or sold with the product). Unauthorized use of the product or any software can impair the product’s performance and may invalidate this One (1) Year Limited Warranty.

LIMITATION OF LIABILITY

IN ADDITION TO THE DISCLAIMER OF ALL OTHER WARRANTIES CONTAINED HEREIN BELOW, IN NO EVENT WILL GLOBAL SENSOR SYSTEMS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, INCLUDING ANY DAMAGES FOR LOST DATA OR LOST PROFITS, ARISING FROM OR RELATING TO THIS LIMITED WARRANTY OR THE PRODUCT, AND GLOBAL SENSOR SYSTEMS, INC.S’ TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THIS LIMITED WARRANTY OR THE PRODUCT WILL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THE PRODUCT BY THE ORIGINAL PURCHASER.  YOU WILL BE SOLELY RESPONSIBLE FOR (AND GLOBAL SENSOR SYSTEMS, INC. DISCLAIMS) ANY AND ALL LOSS, LIABILITY, OR DAMAGES, INCLUDING TO YOUR WIRING, FIXTURES, ELECTRICITY, BUSINESS, PRODUCT, PRODUCT PERIPHERALS, COMPUTER, MOBILE DEVICE, AND ALL OTHER ITEMS IN YOUR BUSINESS, RESULTING FROM YOUR USE OF THE PRODUCT.

DISCLAIMER OF ALL OTHER WARRANTIES

EXCEPT AS STATED IN THIS ONE (1) YEAR LIMITED WARRANTY, WHICH IS THE SOLE AND EXCLUSIVE WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GLOBAL SENSOR SYSTEMS, INC. DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND CONDITIONS WITH RESPECT TO THE PRODUCT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GLOBAL SENSOR SYSTEMS, INC. ALSO LIMITS THE DURATION OF ANY APPLICABLE IMPLIED WARRANTIES OR CONDITIONS TO THE DURATION OF THIS ONE (1) YEAR LIMITED WARRANTY.

YOUR RIGHTS AND THIS LIMITED WARRANTY

This One (1) Year Limited Warranty gives you specific legal rights. You may also have other legal rights that vary by state, province, or jurisdiction. Likewise, some of the limitations in this One (1) Year Limited Warranty may not apply in certain states, provinces or jurisdictions. The terms of this One (1) Year Limited Warranty will apply to the extent permitted by applicable law. For a full description of your legal rights you should refer to the laws applicable in your jurisdiction and you may wish to contact a relevant consumer advisory service.
